Introduction
THESE TERMS OF SERVICE APPLY TO THE USE OF THE UBIT MINING SERVICE, THE WEBSITE OF WHICH IS LOCATED AT THE UBIT DOMAIN ADDRESS.DEV AND ITS SUBDOMAINS. THE WEBSITE AND THE SERVICE ARE THE PROPERTY OF UBIT.
THEY ESTABLISH HOW UBIT ORGANIZES THE WORK OF THE CRYPTOCURRENCY MINING SERVICE AND EXPLAINS ANY ASSOCIATED RIGHTS AND OBLIGATIONS. THE UBIT TERMS OF SERVICE AND ANY OTHER INSTRUCTIONS, MANUALS AND OTHER DATA AVAILABLE ON THE WEBSITE (PERIODICALLY) ARE ALSO APPLICABLE TO ESTABLISH THE PROCEDURE FOR YOUR USE OF THE UBIT MINING SERVICE (COLLECTIVELY, THE "AGREEMENT"). BY USING THE WEBSITE AND/OR THE SERVICE, YOU AGREE TO THESE TERMS OF SERVICE; IF YOU DO NOT AGREE, DO NOT USE THE WEBSITE AND/OR THE SERVICE.
UBIT RESERVES THE RIGHT, AT ITS SOLE DISCRETION, TO AMEND, MODIFY, REVISE, ADD OR REMOVE PORTIONS OF THESE TERMS OF SERVICE AT ANY TIME. IT IS YOUR RESPONSIBILITY TO PERIODICALLY CHECK THESE TERMS OF SERVICE FOR CHANGES. THE CURRENT VERSION OF THESE TERMS IS AVAILABLE AT https://ubit.cards/terms . YOUR CONTINUED USE OF THE WEBSITE AND/OR THE SERVICE, AS WELL AS THE USE OF SUBSEQUENT UPDATES, MEANS THAT YOU ACCEPT AND AGREE TO THE CHANGES. AS SOON AS YOU AGREE TO AND FOLLOW THESE TERMS, UBIT GRANTS YOU A PERSONAL, NON-EXCLUSIVE, NON-TRANSFERABLE, LIMITED PRIVILEGE TO USE THE WEBSITE AND THE SERVICE.
UBIT PROVIDES TECHNICAL SUPPORT, DEVELOPMENT AND MARKETING SUPPORT FOR UBIT AND ITS SUBDOMAINS.
ABOUT THE SERVICE, THE WEBSITE AND THESE TERMS OF SERVICE
1.1. This agreement (referred to as the “Terms”) is between UBIT (also referred to in these Terms as "UBIT”, "we", "us" or "our" and "you”, "your") and a person who has access to and uses the UBIT cloud mining service and accepts these Terms.
1.2. In these Terms and Conditions:
1.2.1. Reference to "Cryptocurrency”, ”Cryptocurrencies" means distributed, decentralized p2p digital currencies:
1.2.1.1. "Bitcoins” is a reference to a Cryptocurrency known as Bitcoin;
1.2.1.2. "Altcoins" is a reference to all Cryptocurrencies other than Bitcoin, such as Ethereum;
1.2.2. "Miners" are persons who register to mine Bitcoins and/or Altcoins using a mining device or service;
1.2.3. "Mining Pool" is an organized association of Cryptocurrency miners. Members of these associations work together to mine Cryptocurrencies, then distributing these Cryptocurrencies to members based on their personal contributions.;
1.2.4. "Mining Equipment" is computer equipment owned by us and used to provide the Service and to mine Cryptocurrencies;
1.2.5. "Hashrate" or "Hashrate” is the working capacity of Mining Equipment used for mining Cryptocurrencies. Hashrate is a specific algorithm for mining Cryptocurrencies (SHA-256, Scrypt, X11 etc);
1.2.6. "Cloud Machine" is the computing power of the Service acquired by the Miner and managed by the Miner through the Website/Platform;
1.2.7. "Service” is a UBIT cloud mining service that allows individual users to remotely mine Cryptocurrencies for themselves using our mining equipment, application and Website;
1.2.8“ "Support” and "Support Service" or "Help Desk" is the UBIT technical support service, which is provided via e-mail/ticket system, and is available in the UBIT Help section;
1.2.9. "Interface" is the graphical user interface of the Service that the Miner interacts with during the use of the Service;
1.2.10. “Website" means ubit.cards and any applications, software, emails or other websites that we use to provide UBIT services (including the Service);
1.2.11. "Payout” is a periodic deposit to your Balance, and depends on the type of your Device or service. Frequency of payments - once a day;
1.2.12. "INCLUDED FEES” are service and electricity charges charged daily from the Balance of existing Contracts;
1.2.13. "Account" is your personal access to the Service, described further in Section 6;
1.2.14. "Balance" is the balance of your personal account;
1.2.15. "Contract" is access to a Device with a certain hashrate;
1.2.16. "Term of the Contract" is the period of time of Device management for which the Miner has agreed to pay. By default, UBIT provides PERPETUAL CONTRACTS that have no expiration date unless otherwise specified.;
1.2.17. "Freezing" is a state in which an Account can be placed for security purposes, and which does not allow this account to make any withdrawals of funds;
1.2.18. "Pre-order" is a contract with the date of commencement of the contract in the future. The start date is calculated and can be changed;
1.2.19. "Referral Program" or "Affiliate Program" is a function that allows the Client to receive funds as a reward for Contracts purchased by other Clients;
1.2.20. The "Referral Code" is an alphanumeric sequence (at least 6 characters long) associated with the Client's Account;
1.2.21. "Referral Link" is a URL with a referral code that allows a new Client to register with UBIT;
1.2.22. "Referral” is a Client who is registered using a Referral Link or another Client's code;
1.2.23. A "Referrer” is a Client who has registered another Client using a Referral Link or code;
1.2.24. "Referral Purchase" or "Recommendation Purchase" is a purchase made by a Referral;
1.2.25. "Referral Bonus" is a reward that a Referral receives for a Referral Purchase;
1.2.26. The "Partner Network" is a third-party website that allows any person (with or without a UBIT account) to receive financial or MINING rewards for UBIT contracts purchased by referral Clients;
1.3. These Terms and Conditions apply to any of your mining carried out using the Service or the Website, and they form a legal agreement between you and UBIT on the acceptance of your application to create an Account (as indicated below);
1.4. If there is a conflict between these terms of service and the UBIT terms of service, instructions, manuals or other similar information posted on the Website, these terms will always take precedence;
1.5. WE CANNOT DETERMINE EXACTLY HOW MANY BITCOINS, LITECOINS AND/OR ANY OTHER CRYPTOCURRENCIES WILL BE MINED BY ANY MINER ON A SEPARATE DEVICE;
1.6. By submitting an application for registration as a Miner, you confirm that you understand and accept (and are able to understand and accept) these terms of service and agree that you will be limited by them. You should regularly check the Website for changes to the Terms of Service, instructions, recommendations and similar information found on the Website;
1.7. You can apply for registration as a Miner only if:
1.7.1. You are over 18 years old;
1.7.2. It is legal for you.
1.8. In order for you to register as a Miner, we may require you to provide us with identification or other information in order to combat fraud and money laundering. This information may include photographic identification and proof of address. We also have the right to independently analyze identification information, fraud cases and financial information;
1.9. Miners are prohibited from visiting the Website and using the Service through anonymous proxies (such as Tor) and other services or technologies that hide the user's real Internet connection.
RISK NOTIFICATION
2.1. Actions carried out with Cryptocurrencies carry inherent risks. Due to the fact that Cryptocurrencies are not regulated and decentralized, their value is not insured by any legal entities. The value of any contract, any amount of any Cryptocurrency can be changed by UBIT due to a number of factors beyond UBIT's control. These factors include, among other things, changes in the complexity of mining and/or other parameters /properties of mining, price fluctuations (in the ratio of the exchange rate of fiat currency in Cryptocurrency, for example USD/ BTC) of Cryptocurrencies, obsolescence and depreciation of equipment. You understand and agree that any Contract and any amount of Cryptocurrency may lose its value at any time due to the nature of Cryptocurrencies. You understand that you are solely responsible for the management of your Cryptocurrencies on your balance sheet, as well as for any losses or fees associated with the action of any third-party organization.
2.2. Any information related to Cryptocurrency and Cryptocurrency Mining that has been posted, published and/or provided by UBIT through any communication channel (including, but not limited to: through the Website, Interface, Support Service, email newsletter, social networks) may be changed.
CRYPTOCURRENCIES
3.1. You must not use, buy, sell, exchange, hold, own or interact with Cryptocurrencies in any way if this is prohibited by laws or regulations applicable to you;
3.2. Cryptocurrencies may be unacceptable to someone. Before mining any cryptocurrencies, you should learn about them to make sure that they are suitable for you. Like all currencies, Cryptocurrencies have drawbacks in use. Some risks of using Cryptocurrencies are as follows:
3.2.1. Fluctuations in exchange rates - the price of Bitcoin and /or any other Cryptocurrency can drop significantly, and a drop is also possible to zero;
3.2.2. Transactions with Cryptocurrencies may remain unconfirmed for some time. In some cases, although quite rare, some transactions remain unconfirmed, an unconfirmed transaction cannot be completed;
3.2.3. Transactions with Cryptocurrencies are irreversible - if you send a certain amount of Cryptocurrency to the wrong person, you will not be able to return these funds;
3.2.4. Cryptocurrencies may be lost if you lose or forget the PIN codes or passwords necessary to access these Cryptocurrencies and transactions with them;
3.2.5. Unknown technical defects inherent in Cryptocurrencies; and
3.2.6. Introduction of new regulatory measures that affect the use of Cryptocurrencies.
3.3. By agreeing to these Terms of Service or by mining Cryptocurrencies using the Service, you show that you understand, are able to understand and accept the risks associated with Cryptocurrencies.
REGISTRATION
4.1. By submitting an application for registration, you make a proposal to conclude an agreement based on these Terms. After submitting the application, you cannot withdraw it;
4.2. Only we can decide on registration. If your application is accepted, a legal and enforceable agreement will be concluded between you and us. Subject to our compliance with all statutory rights, you cannot mark an agreement concluded under these Terms.
DURATION OF THE CONTRACT AND MINING
5.1. These Terms have an unlimited validity period, and are valid even after the Account has ceased to exist;
5.2. The term of the Contract for the use of UBIT Devices is unlimited by default, unless otherwise specified. The contract is valid as long as it makes a profit, until its validity period has expired or until its termination (see Section 13), whichever comes first;
5.3. Contracts with the specified expiration date expire on the expiration date, and the computing Device stops its operation;
5.4. Pre-Order Contracts that are not activated immediately after purchase are activated on the specified date.
ACCOUNT
6.1. In order to register, you will need to send some personal information, an active email address (which will be used as a Username and for user identification) for your Website Account ("Account"), as well as a password (“Password”). You also need to select a country to calculate the appropriate amount of VAT. To be able to withdraw funds, you need to provide at least one Cryptocurrency wallet address that you use. Account features allow you to add more than one Cryptocurrency wallet.
6.2. You must make sure that all information about you that we have is reliable, complete, up-to-date and does not mislead.
6.3. The Username and Password will be assigned to you in case of successful application for registration of you as a Miner.
6.4. To access some parts of the Website, you will need your Username and Password. Your Username and Password are individual and should not be disclosed to any other person.
6.5. The number of Accounts is limited to 1 for each beneficiary.
6.6. When you register, you can send an order for the purchase of capacities. This order will allow you to specify the power of the Device you need. Only UBIT makes a decision on the execution of the order, and the acceptance of the order depends, among other things, on the availability of capacity.
6.7. Your order (order) is a request to receive a Contract from us and it does not constitute a formed contract. If we accept your order, we will link your Contract to your Account. Until then, the order is pending, and UBIT reserves the right to reject your payment.
6.8. Confirmation of your order will be made by means of a letter to the email address specified by you, which will also indicate the expected start date of the Contract. The confirmed start date of the Contract will be communicated to you in the following email. We cannot say how long it will take to confirm the start date of the Contract.
6.9. Subject to payment of all fees that may be applied, miners will be able to receive the amount of Cryptocurrency according to the acquired computing power and the period of time during which the power is in the process of mining. Miners will be able to manage the capacities only during the term of the Contract. The generated Cryptocurrencies will be transferred to your wallet upon your request, if such a request is confirmed.
6.10. If you lose access to your Account, in order to determine the right to manage your Account, UBIT may ask you to provide some data, which may include personal information. The information may include, but is not limited to: identity card; proof of residence; confirmation of phone/email number and any identification information from the Website, for example, transaction IDs, order numbers, withdrawal amounts, etc.
USING YOUR ACCOUNT
7.1. You can mine Cryptocurrencies only for your own benefit. By using the Website and/or the Service, you confirm that you are not acting in the interests of any other person or organization.
7.2. We have the right to assume that any actions within your Account are done by you. You are solely responsible for any use of the Website or Service under your Account, as well as any other use of your Username and Password.
7.3. You can have only one Account. If you have forgotten your Username or Password, you can use the Password recovery function or contact Support.
7.4. DO NOT PROVIDE YOUR PASSWORD TO ANY OTHER PERSON, AND ALSO DO NOT ALLOW YOUR ACCOUNT TO BE USED BY ANOTHER PERSON. WE ARE NOT RESPONSIBLE FOR ANY MISUSE OF YOUR PASSWORD OR ACCOUNT BY YOU OR ANY OTHER PERSON. IF YOU HAVE REASON TO BELIEVE THAT ANY OTHER PERSON KNOWS YOUR PASSWORD, OR THAT YOUR ACCOUNT HAS BEEN USED BY ANOTHER PERSON, YOU SHOULD IMMEDIATELY INFORM US.
7.5. If you do not log in to your account within 12 months, we may terminate your Account. If possible, you will be notified in advance. If we are unable to contact you and you do not take any action to prevent Account termination, your Account will be cancelled.
LIMITATIONS AND RESPONSIBILITIES
8.1. You agree to comply with all applicable laws and regulations, these Terms of Service and all rules applicable to the use of the Website and the Service.
8.2. You agree to honestly provide the data or, conversely, not to distort the data in any interactions with UBIT.
8.3. You are prohibited from abusing any promotions, discounts, referral bonuses and/or referral systems provided from time to time by UBIT and/or its partners.
8.4. You are not allowed to use any means of hiding your Internet traffic and IP address (for example, Proxy, Tor, VPN, etc.).
8.5. Companies representing Multilevel Marketing Systems (MLM) and/or High-Yield Investment Projects (HYIP) are prohibited from providing their users or partners with services based on UBIT services, including, among others, UBIT services and/or products.
8.6. You are strictly prohibited from using or exploiting errors in the design of the Website, the Service and/or any of its parts, and/or documented functions and properties, and/or "software errors” for commercial/personal purposes and/or to destabilize the operation of the Service and/or the Website. If you accidentally encounter a similar error, you need to report it to the Support Service at support@ubit.cards
MINING MANAGEMENT
9.1. During the term of the Contract, you may use the Website to:
9.1.1. To change or update registration information or contact details;
9.1.2. Deactivate or reactivate your Account with the help of the Support Service, as well as terminate the Contract;
9.1.3. Using the Support Service, change the email address to log in to the Account;
9.1.4. To purchase additional mining capacity; and
9.1.5. To change the address of your cryptocurrency wallet.
9.2. Subject to payment of the Contract and additional fees, you can use the Website to:
9.2.1. Add new capacities or update an existing Contract; and
9.2.2. Increase the existing capacity of your Contract.
BALANCE
10.1. Your Balance in the Website Interface is the amount of funds available to you for use.
10.2. The Service may have several Balances at once. Currently, the following types of Balances are available:
10.2.1. The BTC Balance is measured in BTC (Bitcoins) with an accuracy of 0.00000001 BTC (1 Satoshi, the minimum indivisible unit of BTC);
10.3. Other cryptocurrency Balances can be entered and/or deleted at any time.
10.4. Funds received through mining will be directly transferred to your Balance. It can take up to 24 hours from the moment of mining the moment.
10.5. The balance can be used as follows:
10.5.1. You can withdraw funds from your Balance at any time if it meets the minimum withdrawal requirements, unless otherwise specified (this condition may be changed).
10.5.2. You can purchase an additional Contract(s) to increase your total Hashrate.
10.6. UBIT reserves the right to recalculate the Balance(s), power of the Cloud Device(s), hashing speed and algorithms, including, but not limited to, cases where errors or inconsistencies of the Service need to be corrected.
10.7. The balance may be negative. In this case, the Balance must be replenished to the minimum positive level so that withdrawals and/or purchases can be made from it.
FEES
11.1. We provide individual users with a platform that allows them to mine Cryptocurrencies using our Mining Equipment. In turn, we charge a fee for periodic maintenance of Equipment and electricity ("Tariffs"), the amount of fees is calculated based on the amount of electricity consumed and the cost of servicing the specified Equipment. Equipment maintenance costs include, but are not limited to: equipment setup, data center rental fees, testing of Mining Pools, employee salaries, costs for future development and testing, software development, replacement of used and missing parts of Equipment and other expenses necessary to provide the best possible service. Some types of Contracts do not involve the collection of periodic Fees. The availability and description of all Fees for various Contracts can be clarified on the Website.
11.2. The monthly electricity fee is fixed and calculated according to the following formula F = A * q * S * 720 h, where:
  • A is the actual hashrate measured in H/s;
  • q is the power consumption (power/hashrate) measured in kWh/s;
  • S is the cost of electricity (average value for the previous 2 months), indicated in US dollars / kWh;
  • 720 hours - hours for 1 month (at the rate of 30 working days).
  • 11.3. The fees are deducted from your Balance once a day immediately after the payment is made for all active Cloud Devices (if more than 1 is active).
  • 11.4. UBIT reserves the right to change the amount of fees at any time without prior notice.
  • 11.5. Fees are non-refundable.
RESPONSIBILITY
12.1. We provide and maintain the Website and the Service on the basis of the principles “AS IS” and "AS AVAILABLE”, and we are responsible only for providing our services with reasonable attention and competence.
12.2. We do not give any other guarantees regarding the Site or the Service, and we disclaim any responsibility for:
12.2.1. To the extent permitted by these Terms and Conditions, and without affecting any other provisions of Section 12 that may apply, we are not responsible for the accuracy, relevance or reliability of the information and materials contained within and /or provided by the Website, Service, Support Service, e-mail newsletter and social networks. You hereby agree that no equipment, including radio, computer and Internet connection, is at fault, sometimes technical failures may affect the service, human error may also occur, which may lead to distortion of the essence of the information provided and misunderstanding;
12.2.2. Any change in the exchange rate of Bitcoin or any other Cryptocurrency;
12.2.3. Any change in the complexity of mining;
12.2.4. Any changes in the applicable legislation and regulation, as well as acts of any legislator or regulator in any part of the world;
12.2.5. Any communication interruptions or network errors of the Website, Service or any other network;
12.2.6. Violation by any other person of copyright or other rights to use the intellectual property of a third party through the User Content of the Website or Service;
12.2.7. Availability, quality, content or nature of information from External Sites;
12.2.8. Any type of damage or loss caused by viruses or other malicious software that can infect computer equipment, software, data or other property of the user, caused by the actions of any other person who has access to, uses or downloads the Website, Service or any User Content; and
12.2.9. All statements, guarantees, conditions and other provisions that could have an effect, but beyond the scope of this notice.
12.3. We do not accept any liability for any amount for non-fulfillment of any obligations in accordance with these Terms of Service.
12.4. Except as stated above, there are no other warranties, conditions or provisions, express or implied, established by law or otherwise, and all these conditions are hereby excluded by law.
12.5. To the maximum extent permitted by law, we exclude liability for any losses or those losses that you may incur, regardless of whether you have suffered directly or indirectly, as well as direct or indirect losses of the following nature:
12.5.1. Special damage, even if the party was aware of the circumstances that could lead to such special damage;
12.5.2. Loss of expected savings;
12.5.3. Loss of business opportunities and management time;
12.5.4. Loss of location;
12.5.5. Loss of Cryptocurrency resulting from any of the actions or omissions on your part or on the part of third parties;
12.5.5.1. Losses arising in connection with:
12.5.5.2. Any defect or malfunction in any systems that you use to store or transfer Cryptocurrency or to access and use the Website or Service;
12.5.5.3. Any inaccuracy or incomplete information that you provide, including addresses of foreign exchange wallets;
12.5.5.4. Any changes in the amount of cryptocurrency remuneration of Miners;
12.5.5.5. Any changes in the regulatory, legislative or technical environment applicable to Cryptocurrencies;
12.5.5.6. Actions or omissions of any bank or banking service provider; or
12.5.5.7. Any changes in the value of the Cryptocurrency, whatever they may be (including those resulting from the actions or omissions of UBIT).
12.6. To the maximum extent permitted by law, our total liability in respect of any claims made in connection with the use of the Website or Service (regardless of whether it is a breach of contract, a civil offense (including negligence), violation of a statutory duty or otherwise), in the event of direct damage, will be limited to the payment of Costs;
12.7. You agree not to use the Website or the Service in any way if it:
12.7.1. Is illegal;
12.7.2. May cause civil or criminal liability for UBIT; or
12.7.3. May negatively affect the reputation of UBIT.
12.8. You hereby agree to indemnify and to warn us and our officers, Directors, owners, agents, information providers, affiliates, licensors and licensees (collectively, “Exempted persons”) against any liabilities and expenses (including reasonable legal costs) incurred Exempt parties in connection with any claim arising out of:
12.8.1. Any fraud or attempts to mislead, who are you yourself;
12.8.2. Any inaccuracy or defect of the information that you provide to us;
12.8.3. Any violation of the law or rules that you commit;
12.8.4. Use of your Account by another person;
12.8.5. Any violation by you of these Terms of Service; and
12.8.6. Claims from third parties arising from your use of the Website or Service, as well as any of your information or your Account (regardless of whether such use was undertaken by you or not).
12.9. You must cooperate with us in cases of any claims. We reserve the right to take over the protection and control of any issue at our own expense, and otherwise subject you to compensation;
VIOLATION, SUSPENSION AND TERMINATION
13.1. Without limiting any other rights that we have, we may suspend or terminate access to your Account, Website and/or Service, cancel your Account Balance and/or suspend the possibility of withdrawing funds received as a result of mining if you violate any of the provisions of these Terms of Service.
13.2. If we have reason to suspect that you are using the Website or Service fraudulently or improperly, we will block your Account until you can confirm to us:
13.2.1. Your identity; and
13.2.2. That no fraud or violation has taken place.
13.3. We will make reasonable efforts to inform you of any expected termination of the Website or Service.
13.4. If you become aware or suspect that there has been a violation of these Terms of Service by another user or Miner, as well as if fraud has been committed or inappropriate behavior of another user has taken place, you must contact us immediately.
13.5. In case of making any purchase with a Credit Card (see Section 14.2.6.), UBIT has the right to freeze the Client's Account (block the possibility of withdrawing any cryptocurrency funds) for up to 30 days as a security measure regarding the rules and policies related to fraud.
PAYMENT TERMS, ORDER CANCELLATION, ORDER MODIFICATION AND REFUND
14.1. All invoices are issued by default in US dollars. Payments made in another currency must take into account the exchange rate of this currency to the US dollar at the time of account formation, as well as any currency exchange fees.
14.2. The Client can purchase the Contract using various payment methods:
14.2.1 In Bitcoin via Account Balance: buying a hashrate directly through the Account Balance, the automatic version of buying directly from the Balance is also called "Reinvest” or "Reinvestment".
14.2.2. In Bitcoin via Bitcoin transfer: the transfer to BTC is carried out to the Bitcoin address of UBIT, the amount of payment depends on: the amount of the order in US dollars, the exchange rate of USD / BTC at the time of purchase and the commission for the transfer in the Bitcoin network (in this case, third-party conditions and payment commissions may apply);
14.3. The Client has the right not to pay for the order if the order was created, but the Client decided not to finish the order and did not pay for it. The order will change its status to "Expired” after a certain period of time (depending on the payment method), in which case the Customer will not be required to complete the order. UBIT will not process requests for cancellation of unpaid orders, as it is assumed that these orders have the status "Deferred".
14.5. The Client is fully responsible for the accuracy of the payment, including, but not limited to: the recipient's address, the amount to be transferred and payment details:
14.5.1. If the amount specified in the payment is less than the required amount, UBIT reserves the right, at its sole discretion, to adjust the terms of the Contract in accordance with the amount of funds received or request the missing amount to be paid before activating the Contract;
14.5.2. If the amount specified in the payment exceeds the required amount, UBIT reserves the right, at its sole discretion, to adjust the terms of the Contract in accordance with the funds received, to transfer excess funds to the Client's Account Balance or to return the excess through the payment system that the Client originally used to pay for the order;
14.5.3. If the Customer makes a payment with incorrect/insufficient information and/or to the wrong recipient address, UBIT will attempt to process this order in a timely manner. If the recipient's address does not belong to UBIT (directly and/or a third-party service) and/or is not associated with UBIT in any way, UBIT will not be responsible and will reject any claims.
14.5.4. UBIT is not obligated to proactively resolve issues related to payment without a demand submitted by the Client.
14.6. In case of issues related to payment, it is necessary to declare a claim:
14.6.1. The Client has the right to make a claim / start a dispute on a payment issue by contacting the Support Service within 14 days from the date of payment creation and with the presentation of payment confirmation. Requests submitted later than 14 days will not be processed;
14.6.2. UBIT reserves the right to request payment confirmation if there is suspicion or evidence that the payment has not been received, but the Contract has been activated. The Customer is obliged to provide proof of payment within 14 days from the date of receipt of such a request;
14.6.3. Proof of payment may include, among other things: UBIT order number, unique transaction identifier or its number, recipient's address, amount of the transferred amount, account statement from the payment system used;
14.6.4. When making a payment by Credit Card, proof of ownership of this type of payment may be required, as well as identification of the identity;
14.6.5. If the confirmation of payment within 14 days, or if the proof was found insufficient and/or invalid:
14.6.5.1. If the claim was initiated by the Client: UBIT reserves the right to reject the claim(s) of the Client;
14.6.5.2. If the claim was initiated by UBIT: UBIT reserves the right to change/cancel the Contracts related to the claim and adjust the balance of the Client's Account Balance to the amount corresponding to this Contract.
14.7. UBIT reserves the right to replace and/or change the type of Contract and the amount of hashrate at any time. The change in the Contract type will take into account the current market price, and UBIT will make efforts, if possible, not to reduce the total value of the modified Contract. This means that in case of a forced change of the algorithm type (for example, from SHA-256 to Scrypt), UBIT will try, if possible, to provide a Contract of equal or greater value than the original Contract, in accordance with the market price at the time of the change.
14.8. Unless otherwise provided by law or a specific offer, all purchases made are final and non-refundable. UBIT reserves the right to refund funds at its sole discretion. If we refund funds for any specific case, this does not mean that in the future such a refund will take place without fail. This refund policy does not affect any statutory rights that may be applicable.
14.9. In case of refund:
14.9.1.The Client will receive a refund of the funds spent to start the service, if any funds have not been withdrawn from the Client's Account Balance. If any amount has been withdrawn from the Balance, no refund requests will be processed for this Account.
14.9.2. UBIT has the right to cancel or withhold any amount of hashrate and/or funds received through mining at the facilities from the returned purchase from the Account Balance.
14.9.3. UBIT is not obliged to reimburse any funds spent on equipment maintenance or electricity payments;
14.10. In the case of a refund of excess funds or in the case of a refund, UBIT may charge a fee for processing the payment depending on the payment system. The amount of the payment processing fee can be changed:
14.10.1. Bitcoin transfer: 0.005 BTC;
14.10.2. Bank transfer: 50 USD;
14.10.3. Credit card: 25 USD.
COMMUNICATIONS
15.1. The Website may display third-party materials ("User Content").
15.2. Although we are not obligated to do so, we may remove or reject any User Content.
15.3. You agree that we may process and store any content that you transmit to the Website (“
15.4. You can send your content to other Miners on the Website, just as other Miners on the Website can send you User Content.
15.5. You agree to both internal and external distribution of Your Content. Therefore, you should make sure that your content does not contain information that you consider personal and confidential.

15.8. You will not provide, post or transmit any statements, materials or other content within the Website, as well as use the Website in any way if:
15.8.1. Is illegal and may lead to civil or criminal liability;
15.8.2. Violates any copyright or other intellectual property rights of any third party;
15.8.3. Violates the rights of third parties to privacy;
15.8.4. If the content contains any computer virus or other malicious software;
15.8.5. Is offensive, defamatory, discriminatory, obscene or contains pornographic materials;
15.8.6. Oppresses any other person;
15.8.7. Prevents the use of the Website by another user;
15.8.8. Acts under the guise of any moderator, administrator, or person from among the staff, as well as any other person associated with UBIT;
15.8.9. Contains confidential information of any other person;
15.8.10. Requests passwords or personal data;
15.8.11. Contains videos, photos or images of any other person without his permission (or if we are talking about a minor, his legal representative);
15.8.12. Exploits any other person;
15.8.13. If we consider it inappropriate; or
15.8.14. This encourages or provokes any other person to commit any of the actions listed above.
15.9. The Website may contain tools with which you can communicate with us. We will contact you at the email address you provided or by any other type of communication, if it is supported by the Website. Notifications that apply to all of our Miners must be publicly available on the Website. We will assume that you have received a notification at the moment when the notification was posted on the Website or sent to you by email. We will assume that we have received a request from you when we send you a confirmation about it.
15.10. All emails (or other messages) that we send are intended only for the addressee.
GENERAL PROVISIONS
16.1. These Terms of Service apply to your general and consumer rights, and will not limit any rights that you may have and which cannot be excluded in accordance with applicable law. These Terms of Service do not exclude or limit our liability for death or personal injury resulting from our negligence, fraudulent actions or statements, or any legal liability that cannot be limited.
16.2. We may withhold any funds that you owe us from the funds that we owe you.
16.3. These Terms of Service, together with the Terms of Use, Privacy Policy and any instructions and similar information found on the Website (periodically), together constitute the entire agreement between you and UBIT regarding your use of the Website and the Service, as well as the mining of Cryptocurrencies through the Website or Service, except for any other terms.
16.4. Our refusal to enforce any condition does not mean its exclusion.
16.5. If any part of these Terms is found to be invalid, it will be changed to the minimum extent necessary to recognize it as enforceable, while the remaining part of these Terms will remain in force and will be binding.
16.6. No guarantee of compliance of the Website and the Service with the laws of any jurisdiction other than Cyprus is provided.
16.7. The Parties submit to the exclusive jurisdiction of the courts of Quebec. These Terms of Service may be interpreted in accordance with the laws of Cyprus, provided that these Terms of Service will not be interpreted as complying with legal norms of consumer protection, including any rights related to the withdrawal and cancellation of consumer rights.
16.8. The interface of this Website is presented in several languages. In case of a conflict between translations, the English version prevails.
